    Kin To Sue Over Fatal South Side Shooting By Trooper

    PITTSBURGH — A federal lawsuit is being filed over a motorist fatally shot by a Pennsylvania state trooper in Pittsburgh’s South Side.

     

    Nicholas Haniotakis was shot March 15 by Trooper Samuel Nassan III and a Pittsburgh police sergeant. The shots were fired after police said he tried to run them down while refusing to pull over for a DUI stop

     

    An autopsy showed Nassan’s shot was the fatal one.

     

    Nassan, Pittsburgh police officer Terrence Donnelly and the Pennsylvania State Police are named in the lawsuit.

     

    Nassan is the same trooper who shot Michael Ellerbe, an unarmed 12-year-old Uniontown boy in 2002. Ellerbe was fleeing police on foot after running away from a stolen vehicle. That family’s lawsuit was settled last year for $12.5 million.

     

    A lawyer for Haniotakis’ family, Geoffrey Fieger, said state police helped Nassan cover up the facts in the 2002 killing.

     

    “At trial, it was shown that the Pennsylvania State Police assisted Nassan in covering up the facts of the killing,” Fieger said in a statement.

     

    Nassan has declined to comment about the latest shooting. Pennsylvania State Troopers Association lawyer Eric Stoltenberg said the case remains under investigation and needs to be examined separately from other cases.

     

    The attorney representing the Pennsylvania state troopers said it is too early in the investigation to know what really happened. But Eric Stoltenberg believes the facts will show the officers took appropriate action when Haniotakis attempted to use his car as a deadly weapon.

     

    “When that occurs, a police officer has no other option but to utilize deadly force in return in order to eliminate the threat,” Stoltenberg said. “And that’s exactly what we believe the investigation will show in this case.”
